Human resources and employee thresholds
When considering the hiring of new employees, there are some thresholds your human resources department needs to know of.
- 11 employees: OSHA requires posting and keeping records to track workplace safety
- 15 employees: The Civil Rights Act disallows discrimination based on race, color, sex, religion or national origin.
- 20 employees: Individuals over 40 are protected by the Age Discrimination Act
- 50 employees: The Family and Medical Leave Act (FMLA) require you to provide unpaid leave and job protection for pregnant workers or those with a family emergency.
- 100 employees: The Worker Adjustment and Retraining Notification Act (WARN) makes you give notice to workers 60 days before closings and layoffs.
Every state may have different requirements, many of them even stricter than the federal guidelines. Also, if you hold any federal contracts, you have yet another set of reporting requirements.
